Scope of This Privacy Policy
This Privacy Policy applies to personal information that we control in connection with the Services. It does not apply to third-party websites, applications, products, or services that have their own privacy policies, even if they are linked from our Services.
By using the Services, you acknowledge that you have read this Privacy Policy. Where applicable law requires consent for a particular processing activity, we will request that consent separately.
2. Personal Information We Collect
The personal information we collect depends on how you interact with the Services, the features you use, and the choices you make.
Information You Provide Directly
Account and profile information. When you register for an account, we may collect your name, email address, username, password or other authentication credentials, and any profile details you choose to provide. Passwords are stored using security protections appropriate to our authentication system.
Order and customer information. When you make a purchase or request access to a product, we may collect your name, email address, billing address, country or region, company name, tax-related information where required, order details, transaction identifiers, and records of the lab packages, workbooks, labs, downloads, or training materials you purchased or accessed.
Newsletter and resource registration information. When you subscribe to our emails or request a free lab, workbook, checklist, guide, or other resource, we may collect your name, email address, subscription preferences, the form or page through which you subscribed, and the date and time of your request.
Communications and support information. If you contact us, respond to a survey, submit feedback, or request support, we collect the information in your message and any files or details you choose to provide.
Information Collected Automatically
When you use the Services, we and our service providers may automatically collect technical and usage information, such as your Internet Protocol address, browser type, device type, operating system, approximate location derived from your IP address, referring and exit pages, pages or features viewed, links clicked, access times, session information, download activity, and diagnostic, security, and error logs.
We may collect this information through cookies, pixels, local storage, log files, and similar technologies. Section 9 explains these technologies and the choices that may be available to you.
Email Delivery and Engagement Information
When we send you an email, we and our email service providers may collect delivery and engagement information, including whether the message was delivered, opened, or clicked, and whether it resulted in a bounce, spam complaint, or unsubscribe request. We may also process message identifiers, timestamps, IP address information, and device or browser information related to email activity. We use this information to operate our email program, measure performance, improve relevance, troubleshoot delivery, protect our sender reputation, and honor recipient preferences. Some email applications or privacy settings may limit or alter the accuracy of open and engagement data.
Payment Information
Payments are processed by third-party payment processors. We do not intend to collect or store your complete payment card number or card security code. The payment processor may provide us with limited information such as your name, billing address, payment method type, the last digits of a payment method, transaction status, and transaction identifier. The payment processor’s handling of your payment information is governed by its own privacy policy and terms.
Sensitive Personal Information
Our Services are not designed to require sensitive personal information such as government identification numbers, precise geolocation, health information, biometric information, or information about racial or ethnic origin, religious beliefs, political opinions, or sexual orientation. Please do not send us sensitive personal information unless we specifically request it and explain why it is needed.
3. Sources of Personal Information
We collect personal information directly from you when you create an account, complete a form, subscribe to emails, request or download a resource, place an order, use the Services, or communicate with us. We also collect information automatically from your browser or device and receive limited information from service providers that help us process payments, deliver emails, host or secure the Services, provide analytics, prevent fraud, or support our operations.
We do not purchase, rent, scrape, or use third-party email lists for our marketing communications. We send marketing emails only to recipients who directly requested them from Dynamips through our website, account, checkout, or resource forms and who provided any consent required by applicable law.
4. How We Use Personal Information
We may use personal information for the following purposes:
Provide and administer the Services. Create and manage accounts, authenticate users, provide requested resources, deliver purchases, enable access to lab packages, workbooks, labs, downloads, and training materials, and maintain service functionality.
Process transactions. Complete purchases, confirm payments, issue receipts, provide order support, process refunds where applicable, and maintain business, tax, and accounting records.
Communicate with you. Send account, security, purchase, access, support, and other service-related communications, respond to questions, and provide customer support.
Send requested educational and marketing communications. Send newsletters, including our Tuesday Emails, technical learning content, product announcements, updates, offers, and other communications consistent with your choices and applicable law.
Personalize and improve the Services. Understand how the Services and communications are used, improve content and user experience, diagnose technical issues, conduct research and analytics, and develop new features and materials.
Maintain safety, security, and integrity. Protect accounts and systems, detect or prevent fraud, spam, malware, abuse, and security incidents, enforce our terms, and preserve evidence where necessary.
Comply with legal obligations and protect rights. Comply with applicable laws, regulations, court orders, and lawful requests, establish or defend legal claims, and protect the rights, safety, and property of Dynamips, our users, and others.
Operate our business. Maintain internal records, audit our operations, manage vendors, plan and evaluate our business, and support a corporate transaction as described in this Privacy Policy.
5. Legal Bases for Processing
If the laws of the European Economic Area, the United Kingdom, Switzerland, or another jurisdiction require us to identify a legal basis for processing, we rely on one or more of the following bases, as applicable:
Performance of a contract. We process information when necessary to provide the Services you request, administer your account, deliver a purchase or resource, process a transaction, or provide support.
Consent. We rely on consent when required for marketing emails, certain cookies or similar technologies, or another specific processing activity. You may withdraw consent at any time, subject to applicable law.
Legitimate interests. We process information to secure and improve the Services, prevent fraud and abuse, understand service performance, communicate with customers, and operate our business, when those interests are not overridden by your rights and interests.
Legal obligation. We process information when necessary to comply with tax, accounting, consumer protection, law enforcement, or other legal requirements.
Legal claims and vital interests. Where applicable, we may process information to establish, exercise, or defend legal claims or to protect a person’s vital interests.
6. Email Communications
Service and Transactional Emails
We may send service or transactional emails that are necessary to operate the Services or complete an interaction with you. These messages may include email address verification, account notices, password resets, purchase confirmations, receipts, access or download information, security alerts, material service changes, and responses to support requests. Because these messages are not marketing messages, you may continue to receive them while you maintain an account or active relationship with us, even if you opt out of marketing emails.
Educational and Marketing Emails
If you subscribe or otherwise request these communications, we may send our weekly Tuesday Emails, networking practice and learning content, updates about lab packages, workbooks, labs, downloads, and training materials, product news, and occasional promotions or offers. Our usual newsletter cadence is weekly, with occasional additional messages when relevant to a requested resource, product, or time-sensitive announcement.
Every marketing email includes a clear unsubscribe mechanism. You may also unsubscribe by contacting us at [email protected]. We process unsubscribe requests promptly and within the period required by applicable law. After you unsubscribe, we may retain your email address on a suppression list so that we can honor your request and avoid sending future marketing messages to that address.
Bounces, Complaints, and Suppression
We monitor delivery failures, spam complaints, and unsubscribe requests. We suppress an address from future marketing sending when a message produces a hard bounce, a recipient reports a message as spam, or a recipient unsubscribes. We may also suppress an address when continued sending could harm recipients, our systems, or our sender reputation. We may use Amazon Simple Email Service, also known as Amazon SES, and other email service providers to deliver messages and process delivery events.
7. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients for the purposes described in this Privacy Policy:
Service providers. Companies that provide website and application hosting, cloud infrastructure, content delivery, data storage, authentication, email delivery and automation, payment processing, analytics, customer support, security, fraud prevention, error monitoring, and other operational services. This may include Amazon Web Services for cloud and Amazon SES email services.
Professional advisers. Lawyers, accountants, auditors, insurers, and other advisers when reasonably necessary for their services.
Legal and public authorities. Courts, regulators, law enforcement, government authorities, or other parties when we believe disclosure is required by law or necessary to respond to lawful requests, protect rights and safety, investigate fraud or security issues, or enforce our agreements.
Business transaction participants. Potential or actual buyers, investors, lenders, advisers, and other participants in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, subject to appropriate confidentiality and legal safeguards.
Parties you direct or authorize. Other parties when you request or consent to the disclosure.
We require service providers to process personal information only for the services they provide to us, subject to contractual, confidentiality, and security obligations appropriate to their role. We do not permit them to use personal information for their own independent purposes except where disclosed to you or permitted by law.
8. Sale, Sharing, and Targeted Advertising
We do not sell or rent subscriber email addresses or other personal information for money. Some privacy laws use the terms “sale” or “sharing” broadly and may treat certain disclosures involving analytics, advertising technologies, or cross-context behavioral advertising as a sale, sharing, or targeted advertising, even when no money is exchanged. If we engage in activity that is subject to those definitions, we will provide any notice and opt-out method required by applicable law. Where available, you may use our cookie preference tool or contact us at [email protected] to submit an applicable request.
9. Cookies and Similar Technologies
We and our service providers may use cookies, pixels, local storage, software development kits, and similar technologies to operate, secure, measure, and improve the Services and our communications. These technologies may fall into the following categories:
Strictly necessary technologies. Required for core functions such as account authentication, session management, security, fraud prevention, shopping or checkout functionality, and preference storage.
Functional technologies. Remember choices and provide enhanced or personalized functionality.
Analytics and performance technologies. Help us understand visits, traffic sources, feature usage, errors, and the performance of the Services and communications.
Advertising technologies. May be used, if enabled, to measure campaigns, limit repetition, or provide more relevant advertising in accordance with applicable law.
You can control cookies through your browser settings. Blocking or deleting some cookies may cause parts of the Services to function improperly. Where a cookie preference tool is available on our Site, you may use it to manage non-essential technologies. Your browser or device may also offer privacy controls, although the Services may not respond to every signal unless required by applicable law.
10. International Data Transfers
Dynamips and its service providers may process personal information in the United States and other countries that may have data protection laws different from those in your country. When applicable law requires safeguards for an international transfer, we use appropriate measures, which may include adequacy decisions, contractual protections such as standard contractual clauses, or another lawful transfer mechanism. You may contact us for more information about safeguards relevant to your personal information.
11. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business and transaction records, comply with legal, tax, accounting, and reporting obligations, resolve disputes, enforce agreements, prevent fraud and abuse, and protect the security and integrity of the Services.
The retention period varies according to the type of information, the nature of our relationship with you, legal requirements, the sensitivity of the information, and operational or security needs. For example, account information may be kept while your account is active and for a reasonable period afterward, purchase and tax records may be kept for legally required periods, and support communications may be kept as needed to resolve and document an issue.
Marketing subscription information is retained while you are subscribed or while we otherwise have a lawful basis to communicate with you. If you unsubscribe or submit a complaint, we may retain limited suppression information for as long as necessary to honor that request and demonstrate compliance. When information is no longer required, we delete it, anonymize it, or isolate it from active use, subject to backup, legal hold, and technical limitations.
12. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. These safeguards may include access controls, authentication measures, encryption in transit where appropriate, monitoring, backups, vendor controls, and procedures for responding to security incidents.
No method of transmission over the Internet or electronic storage system is completely secure. We therefore cannot guarantee absolute security. You are responsible for choosing a strong, unique password, protecting your credentials, and notifying us promptly if you believe your account or information has been compromised.
13. Your Privacy Rights and Choices
Depending on where you live and subject to applicable exceptions, you may have the right to request access to or a copy of personal information we hold about you, obtain information about how it is processed, correct inaccurate information, delete personal information, receive certain information in a portable format, restrict processing, object to certain processing, withdraw consent, and opt out of a sale, sharing, or targeted advertising as those terms are defined by applicable law.
You may also have the right to appeal a decision we make about your request and to lodge a complaint with a data protection authority or other privacy regulator. Withdrawing consent does not affect the lawfulness of processing that occurred before the withdrawal.
How to Exercise Your Rights
To submit a privacy request, email [email protected] with the subject line “Privacy Request” and describe the right you wish to exercise. You may also update certain account information by signing in to your account, if that functionality is available. To opt out of marketing emails, use the unsubscribe link in the message or contact us at the address above.
We may need to verify your identity before completing a request. We will use information provided for verification only to process and document the request. If an authorized agent submits a request for you, we may require proof of the agent’s authority and may also ask you to verify your identity directly, as permitted by law. We will not unlawfully discriminate against you for exercising a privacy right.
Privacy rights are not absolute. We may deny or limit a request where an exception applies, such as when information is needed to complete a transaction, protect security, prevent fraud, comply with law, preserve legal claims, or protect the rights of others. If we deny a request, we will explain the basis for the decision when required.
14. Account Deletion
You may request deletion of your account by emailing [email protected] with the subject line “Account Deletion Request.” We may verify your identity before acting on the request. Account deletion may remove or disable access to purchased or downloaded materials and may not be reversible. We may retain information that we are legally permitted or required to keep, including transaction, tax, security, fraud prevention, dispute, legal claim, and suppression records.
15. Children’s Privacy
The Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child under 16 has provided personal information to us, contact us at [email protected]. We will review the request and take appropriate steps to delete the information where required by law.
16. Third-Party Websites and Services
The Services may contain links to third-party websites or services. We do not control those third parties and are not responsible for their privacy, security, or content practices. We encourage you to review the privacy policy of each third party before providing personal information or using its services.
17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our Services, practices, technology, providers, or legal obligations. We will post the updated version on this page and revise the “Last updated” date. If a change is material, we may provide additional notice, such as an email or a prominent notice on the Services, when required by applicable law.
